1. About toolshare

toolshare is a peer-to-peer marketplace that connects people who want to rent items ("renters") with people who list them ("listers"). toolshare facilitates listings, bookings, payments, and communication. toolshare is not the owner of listed items and is not a party to the rental agreement between renter and lister.

2. Eligibility and accounts

You must be at least 18 years old and provide accurate account information. You are responsible for activity on your account.

3. Phone verification

Before submitting your first rental request, you must verify your phone number with a one-time code sent by SMS. This is a one-time requirement per account.

4. Listings

Listers are responsible for the accuracy of their listings, including condition, price, availability, and any deposit amount. Listers set their own daily price and may set an optional security deposit.

5. Bookings and payment

When a renter submits a request, the rental total is charged at that time. The rental total includes the daily rate multiplied by the number of rental days, a service fee, an optional damage waiver if selected, and a delivery fee if applicable. The service fee covers payment processing costs.

6. Lister payouts

Listers receive 90% of the rental subtotal plus 100% of any delivery fee. toolshare retains 10% of the rental subtotal as a platform fee. Payouts are issued to the lister's connected payment account after the rental is completed.

7. Security deposits

Listers may set an optional security deposit for their listing. If a deposit is set, it is placed as a temporary authorization hold on the renter's payment method at the time of handoff — not at booking. The renter's card is authorized but not charged. On a clean return, the hold is released automatically. If the lister reports damage at return, the deposit may be claimed to cover repair or replacement costs, subject to toolshare's review.

8. Damage waiver

The damage waiver is an optional, non-refundable charge added at checkout. If selected, it contributes to a reserve fund held by toolshare. In the event of accidental damage beyond the security deposit amount, this fund may help offset repair or replacement costs, at toolshare's discretion. The damage waiver is not insurance and does not guarantee coverage of any specific amount.

9. Cancellations and refunds

If a lister declines a request, the renter is refunded in full.

If a renter cancels a request before pickup (whether the request is still pending or has been approved), the renter is refunded in full, including the service fee.

Once an item has been picked up and the rental is active, it can no longer be cancelled — it must be returned.

10. No-shows

If a renter does not pick up an approved item before the rental window ends, the rental is automatically cancelled as a no-show. In that case, the lister is compensated for the reserved time and the renter receives a partial refund. Any damage waiver paid is refunded to the renter.

11. Returns and disputes

At return, either party may initiate the return and the other confirms it. Listers may report an issue (such as damage) at the point of return. If an issue is reported, the security deposit remains held while toolshare reviews the dispute. toolshare may release the deposit back to the renter or claim it toward documented repair or replacement costs.

12. Damage & Non-Return Authorization

By completing a rental on toolshare, you authorize toolshare to charge your saved payment method for the documented cost of damage, loss, or non-return of a rented item, as confirmed through toolshare's dispute resolution process. This charge may exceed your original security deposit amount. toolshare will only pursue such a charge after reviewing the claim, including any documentation provided by the item's lister, and giving you an opportunity to respond.

13. Prohibited use

You may not list, rent, or use items for illegal purposes, or list items you do not own or have the right to rent.

14. Liability

toolshare provides a platform and is not responsible for the condition, safety, or legality of listed items, or for the conduct of users. Renters and listers are responsible for inspecting items and agreeing on their use. To the maximum extent permitted by law, toolshare's liability is limited.

15. Changes to these terms

We may update these terms. Continued use of toolshare after changes constitutes acceptance.
